To become a real estate agent in New South Wales, you may start as an Assistant Agent and apply for a Certificate of Registration – NSW Assistant Agent with Service NSW. To be eligible for the certificate, you must: be aged 16 years or over be a fit and proper person to hold a certificate of registration have the right qualifications for the type of certificate you are applying for not be a disqualified person. How do I become a licensed real estate agent in NSW? To become a licensed real estate agent in New South Wales, you need to apply for a real estate agent licence with Service NSW. To be eligible for the licence, you must: Be at least 18 years of age Be a fit and proper person have the qualifications required for the licence class you are applying for You have completed the required work experience tasks. Your previous licence (or certificate of registration) has not been disqualified. Your principal place of business is either in NSW or within 50km of the NSW border. There are two types of licences – class 2 and class 1. Kaplan Professional’s online CPP41419 Certificate IV in Real Estate Practice meets the educational requirements to apply for a class 2 licence. Kaplan Professional does not currently offer education for a class 1 licence. Can I use my certificate of registration or licence in another state or territory to where I qualified? It depends on the state or territory you want to use your real estate certificate of registration or licence in. Under the terms of Australia’s Mutual Recognition Act 1992 (MRA), if you have a real estate certificate of registration or licence issued by one state or territory, you can use it to apply to be registered or licensed in another state or territory in an equivalent occupation. It’s then up to the licensing authority in that state or territory to decide if your qualifications are similar enough to their requirements to issue you with an equivalent certificate or licence. Some jurisdictions will recognise all of your qualifications.However, some will only recognise part of your qualifications and in certain occupations mutual recognition won’t apply. Since there’s so much variation in occupational licensing laws, you’ll need to visit the state or territory’s Office of Fair Trading website to determine the exact requirements of the state or territory you’re planning to apply to. If the website confirms you can apply for mutual recognition, contact the specific state or territory’s registration authority. If your application is successful, pay any fees involved in issuing an equivalent certificate or licence. If you are applying to have your interstate qualifications recognised in NSW, then you need to apply to Service NSW. What’s the difference between a NSW real estate certificate of registration and a licence (class 2 and class 1)? The NSW real estate industry has a structured qualification process that promotes hands-on experience prior to obtaining a real estate licence. The first stage in this process is obtaining a real estate certificate of registration to work as an Assistant Agent. With this certificate, individuals can work in the real estate industry under the guidance of a fully licensed real estate agent or agency. The next stage in the qualification process after a certificate of registration is gaining a real estate licence. This enables you to work as a real estate agent (class 2) or manage or own a real estate agency (class 1). Specifically, a class 2 licence allows you to: act as an agent for a client to sell, buy or exchange property, businesses or professional practices negotiate with clients and vendors collect rent, deposits, bond payments and fees related to a lease, licence or contract. A class 1 licence allows you to do all of the above, and: act as a licensee in charge (LIC), including open and authorise trust account transactions for the business work independently as a sole trader. How long does it take to complete a real estate course in NSW? It depends on the amount of prior knowledge you have of the NSW property industry, and how much time you’re able to commit to coursework and assessments. You have up to 12 weeks to complete the learning and assessment requirements for the Certificate of Registration – NSW Assistant Agent program with an additional 4 weeks’ resubmission time if you reach the end of your 12-week period and are deemed ‘not yet demonstrated’ in one or more assessment items (provided you attempted all the tasks during your initial enrolment period). If you use the full learning and assessment time, and are granted resubmission time, the duration is 16 weeks. If for any reason you can’t complete the course within this timeframe, you can request an extension for an additional fee. The CPP41419 Certificate IV in Real Estate Practice – NSW Class 2 Real Estate Licence is a more in-depth course, so you have up to 48 weeks to complete this course, with additional resubmission time of 4 weeks per subject. The resubmission time is granted for a subject if you reach the end of that subject and are deemed ‘not yet demonstrated’ in one or more assessment items (provided you attempted all the tasks during your initial enrolment period). If you use the full learning and assessment time and are granted resubmission time for all subjects, the duration is 64 weeks.
